RULE 1901 PROMPT DISPOSITION OF MATTERS; TERMINATION OF INACTIVE CASES
The Prothonotary,
Register of Wills/Clerk of Orphans Court, and Clerk of Courts shall prepare and
forward to the District Court Administrator a list of all cases in which no
steps or proceedings have been taken for two years or more by the 15th day of
September for call on the first Monday of December of each year, or, on such
other date as the Court by special order may direct. As provided by Pa.R.J.A.
1901 (c), notice shall be given to all parties and/or attorneys. If no action is taken or written objection
filed and, if no good cause is shown, the Court shall enter an order dismissing
the proceedings.
The Magisterial District Courts shall
comply with the following:
A. Traffic Cases - Summary traffic
violations or parking violations whereby a warrant has been issued pursuant to Pa.R.Crim.P. 430(A), Rule 430 (B)(1)(a) or Rule 430 (B)(2).
1. On
or before the 15th day of November of each year, each Magisterial District
Court shall:
a. Dismiss any summary citation or ticket filed under Title 75
(relating to vehicles) or under local ordinance pertaining to overtime parking
which was issued three years prior to November 15th of each respective year.
b. Vacate any active warrant issued on the dismissed summary
citation or ticket and promptly remove the warrant from MDJS database.
c. Forward notice to the Pennsylvania Department of
Transportation that the citation/ticket has been dismissed and request withdrawal
of the defendant's license suspension, if applicable, pursuant to Pa.R.Crim.P. 470.
2. Each
Magisterial District Court shall promptly provide a list of those cases being
dismissed to the District Court Administrator.
B. Non-Traffic Cases
1. On
or before the 15th day of November of each year, each Magisterial District
Court shall:
2. Identify
all non-traffic summary cases where no plea has been entered and there is no
evidence of activity in the three years prior to November 15th of each respective
year.
3. Compile
a list for all cases identified in number 2 above and attach a secure docket
sheet that indicates the name of the affiant, the name of the defendant, the
docket number and the charge(s) associated with the docket number.
4. Forward
this list with attachments to the District Court Administrator.
C. Upon receipt of the lists, the District
Court Administrator shall:
1. Publish
the lists in the Carbon County Law Journal.
2. Provide
a copy of the lists to the Carbon County District Attorney.
D. The publication shall include a notice
that the matters listed shall be terminated after thirty (30) days of
publication unless a party to the proceeding requests a hearing from the
appropriate Magisterial District Court.
1. If
the defendant requests a hearing, the matter shall promptly be scheduled for
such hearing or other disposition pursuant to the Rules of Criminal Procedure.
2. If
the Commonwealth requests a hearing to oppose termination, the matter shall promptly
be scheduled to determine if termination is appropriate.
3. Disposition
of any hearing, including hearings where a citation or ticket is dismissed over
the objection of the Commonwealth shall be filed of record in the MDJS.
4. The
Commonwealth shall have the right to appeal any determination to the Court of
Common Pleas within the time period for Summary Appeals pursuant to the Rules
of Criminal Procedure.
E. In the event a hearing is not requested
within thirty (30) days of publication, the Magisterial District Judge shall:
a. Dismiss any summary citation or ticket filed which was issued
three years prior to November 15th of each respective year.
b. Vacate any active warrant issued for the dismissed summary
citation or ticket and promptly remove the warrant from MDJS.
c. Forward notice to the Pennsylvania Department of
Transportation that the citation or ticket has been dismissed and request

The Committee has reviewed proposed
Carbon County Rule 106 that was submitted to the Committee pursuant to Rule of
Criminal Procedure 105(D). The Committee has determined that the rule is not
inconsistent with the statewide Rules of Criminal Procedure.
The Committee's review of the rule
does not include determining the wisdom of the rule, the substantive validity
of the provisions of the rule, or the merits of the rule.
The proposed rule may now be
published in accordance with Rule 105(E).
As required by Rule 105(F)(2), the rule also is
required to be published on the Unified Judicial System's web site at http://ujsportal.pacourts.us/localrules/ruleselection.aspx.
The procedures for publishing the
rule are explained on the Help page of the UJS Portal. The rule should be uploaded to the UJS Portal
at the time of publication or, if the rule had been uploaded to the UJS Portal
prior to publication, you must inform the Committee of the publication date,
either by telephone, mail, or e-mail.
One final point concerning this
rule. The programming of the UJS Portal requires
that local rules or administrative orders be associated with a matching
statewide rule. Accordingly, you will need to assign a rule number matching the
applicable statewide rule. Alternatively, if there is no corresponding
statewide rule to which the administrative order
can be
associated, the AOPC has established on the UJS portal a generic
"Administrative Order rule" to meet this programming
requirement. These types of
Administrative Orders are to be keyed to this generic rule. There are instructions in the UJS Portal Help
page explaining how this is to be accomplished.

RULE 106 CONTINUANCES IN SUMMARY AND COURT CASES
(a) All
Motions for Continuance shall be filed at least two (2) working days before the
scheduled event. Motions shall be filed
pursuant to Pa.R.Crim.P. 575 or can be filed by
utilizing the attached form titled Motion for Continuance - Criminal. All continuances must indicate the case
number, defendant's name, type of event being continued, date of the event
being continued and number of previous continuances. A Rule 600 speedy trial waiver must be
attached if the defendant consents to this motion for continuance. The moving party shall secure the signature
or indicate the position of the opposing party.
(b) When a Motion for
Continuance is requested because of counsel's attachment in another Court, a
copy of the attachment shall accompany the Motion for Continuance. If the reason for filing a continuance is that
the defendant is ill, receiving medical treatment or in rehabilitation, the
attorney/pro se party must provide documentation from the treating physician or
other qualified person documenting the defendant's illness or treatment, and,
in the case of defendant's rehabilitation, a written statement from the
facility at which the defendant is receiving treatment, confirming admission
and continued care at such facility.
(c) When a defendant has two or more cases
scheduled for the same date and time, only one continuance motion/form listing
all the case numbers is required to be filed.
When a continuance is requested for events scheduled for different dates
or at different times, a separate continuance motion/form must be filed for
each event.
(d) Upon filing the motion/form in the Clerk of
Courts Office, concurrent service of the Motion/Form for Continuance shall be
pursuant to Pa.R.Crim.P. 576.
(e) Any
motion filed that is not in compliance with this rule shall be entertained only
if the opportunity to timely file it did not exist previously, the defendant
was not aware of the grounds for the motion, or the interests of justice so
require.
Failure of any motion/form for
continuance to comply with this rule shall be grounds for denying the requested
continuance.
